SPECIAL SESSION
APRIL 18, 2014
The City Council of the City of Sibley met in special session at 7:00 o’clock AM on
April 18, 2014. The meeting was called to order by Mayor Johnson. Council Members present were Groote, Pedley, Nobles by phone, Henningsen and Buchholtz. Absent none. Also present at the meeting City Administrator Glenn Anderson, City Clerk Kris Vipond, Harold Dawson and Wade Ellerbroek.
Motion by Buchholtz seconded by Groote to approve the agenda. All voted Aye. Nay none.
Discussion was held regarding Timewell and the railroad. Glenn met one on one with Daren from Timewell on Wednesday. Jerry & Gail also met with Daren, and Daren toured power plant with Gary Obbink. Council reviewed Union Pacific’s Consent to Joint Use of Track Agreement and Industry Track Agreement. Attorney Dawson notified City Council that there is a clause to back out of the Union Pacific agreements with 30 days notice and that these agreements need to be completed in order to purchase the property from Union Pacific. Motion by Nobles seconded by Buchholtz to approve the Mayor’s signature on the Consent to Joint Use of Track Agreement and the Industry Track Agreement. All voted Aye. Nay none.
Councilperson Nobles disconnected at 7:28 P.M.
Motion by Buchholtz seconded by Henningsen to adjourn at 7:40 A.M. All voted Aye.

APRIL 24, 2014
The City Council of the City of Sibley met in special session at 7:00 o’clock AM on
April 24, 2014. The meeting was called to order by Mayor Johnson. Council Members present were Groote, Pedley, Nobles by phone, Henningsen and Buchholtz. Absent none. Also present at the meeting City Administrator Glenn Anderson, City Clerk Kris Vipond, Harold Dawson, Jayson Vande Hoef and Wade Ellerbroek.
Motion by Pedley seconded by Groote to approve the agenda. All voted Aye. Nay none.
Discussion was held regarding the railroad and DPD and Timewell’s requests regarding the timeline, track costs/car charges, future hookups, usage to the east of Timewell, deed, minimum assessment and financial input from each party. The best case scenario for the timeline is that the Urban Renewal Plan can be updated; the sale of bonds and acceptance of bids could be completed by June 13, 2014. If the construction bid documents require construction to start within 5 days, given an 8 week estimated construction time the project could be done by mid to late August. The first payment would not be before 30 days after the start of construction due to bond receipts not being available until mid-July. It was noted that following negotiations, 2 separate agreements would be needed (1 with DPD and 1 with Timewell).
Councilperson Nobles disconnected at 7:30 A.M.
Councilperson Groote left the meeting at 7:45 A.M.
Motion by Henningsen seconded by Buchholtz to authorize City Administrator Anderson to contact Timewell and DPD with the Council’s response to their requests and to negotiate a tentative agreement.
Motion by Henningsen seconded by Buchholtz to adjourn at 8:05 A.M. All voted Aye.
