The Board of Supervisors met as per adjournment in regular session at 9:00 a.m. with all members present.

Moved by Friedrichsen, seconded by Farnsworth to approve the proceedings of June 3, 2014. Motion carried by all ayes.

At 9:02 a.m. a hearing was held on the proposed expansion of the Van Ess Dairy in the SW ¼ of Section 17, Lincoln Township. The expansion is to construct three buildings. The facility will have a total capacity of 5,900 head of dairy cattle. There were no objections presented.

Moved by Friedrichsen, seconded by McDowell to approve the Van Ess Dairy expansion in Section 17, Lincoln Township to construct three buildings. The site scored a total of 455 points and meets the requirements of the matrix. Motion carried by all ayes. These actions were rescinded on June 17, 2014 as the hearing was scheduled for June 17th – not June 10th.

Moved by Farnsworth, seconded by Steensma to adopt the following resolution. Motion carried by all ayes.

Resolution No. 2014-28
RESOLUTION OF THE BOARD OF SUPERVISORS, O’BRIEN COUNTY, IOWA

WHEREAS, the Board of Supervisors is empowered under authority of Section 306.41 of the Code of Iowa to temporarily close sections of road by formal resolution when they deem necessary for construction, maintenance, or natural disaster,

AND WHEREAS, the Board of Supervisors, County of O’Brien, have determined that the following section of road should be temporarily closed due to road construction:

Bridge Repairs (23-24 Center) McDowell Bridge

County road Tyler Ave. from 360th Street to 370th Street

NOW, THEREFORE, BE IT RESOLVED, that the above described roads be closed temporarily in the manner described below.

“ROAD CLOSED” signs shall be placed on both ends of the described segments of road, and they shall remain in place until the construction is completed.

Moved by Friedrichsen, seconded by Farnsworth to consider an amendment of the wind permit for MidAmerican Energy on June 24, 2014 at 10:00 a.m. Motion carried by all ayes.

 

 

At 10:00 a.m., in accordance with the Code of Iowa, the Board canvassed the Primary
Election returns for O’Brien County and declared the following candidates nominated:

County Supervisor, Dist. 4 – Tom Farnsworth – Republican
County Supervisor, Dist. 5 – Dan Friedrichsen – Republican
County Treasurer – Phyllis Rohlfsen – Republican
County Recorder – Susan Smith – Republican
County Attorney – Micah J. Schreurs – Republican

Moved by Farnsworth, seconded by Steensma to approve the fireworks permit applications of Community Memorial Health Center at 231 N 8th Ave. W Hartley and Dustin Evans at 4718 450th St. Granville. Motion carried by all ayes.

Moved by Friedrichsen, seconded by Steensma to approve the appointment of Kyle Fischer as a full-time Jail Officer effective May 27, 2014 at $16.50 per hour. Motion carried by all ayes.

Moved by Farnsworth, seconded by McDowell to adopt Resolution No. 2014-27; a Resolution to approve the waiver of the County’s right to appeal issuance of the final construction permit for the Summit Dairy expansion. Motion carried by all ayes.

June 17, 2014

The Board of Supervisors met as per adjournment in regular session at 9:00 a.m. with all members present.

Moved by Friedrichsen, seconded by Farnsworth to approve the proceedings of June 10, 2014 except to rescind all actions regarding the Van Ess Dairy hearing and approval. The hearing was inadvertently held a week prior to the advertised date and time of June 17, 2014. Motion carried by all ayes.

At 9:02 a.m. a hearing was held on the proposed expansion of the Van Ess Dairy in the SW ¼ of Section 17, Lincoln Township. The expansion is to construct three buildings. The facility will have a total capacity of 5,900 head of dairy cattle. There were several people present at the hearing with concerns of the odor. The Van Ess’ responded to the comments regarding the odor of the existing dairy and that they have made and continue to seek solutions to the issues with the high sulfates that is believed to cause the odor issues.

Moved by Friedrichsen, seconded by McDowell to approve the Van Ess Dairy expansion in Section 17, Lincoln Township to construct three buildings. The site scored a total of 455 points and meets the requirements of the matrix. Motion carried by all ayes.

Moved by Farnsworth, seconded by Steensma to authorize the Chairman to sign the Law Enforcement Agreement with the City of Primghar for fiscal 2015. Motion carried by all ayes.

Moved by Farnsworth, seconded by Friedrichsen to approve the drain tile crossing application of Bruce Rohwer in Section 27, Dale Township. Motion carried by all ayes.

Moved by Friedrichsen, seconded by McDowell to approve the utility construction application of Osceola Rural Water between Sections 21 & 22, Highland Township. Motion carried by all ayes.

Moved by Farnsworth, seconded by Steensma to adopt the following resolution. Motion carried by all ayes.

Moved by Farnsworth, seconded by McDowell to approve the fireworks permit application of Dennis Ten Clay at 3141 Monroe Ave. Sheldon. Motion carried by all ayes.

Moved by Friedrichsen, seconded by Farnsworth to accept the resignation of Tim Aberson as a member of the County Conservation Board. Motion carried by all ayes.

Moved by Farnsworth, seconded by Steensma to appoint Darwin Dau to the O’Brien County Conservation Board to fill the vacancy created by the resignation of Tim Aberson. Motion carried by all ayes.

Moved by Farnsworth, seconded by Friedrichsen to give approval for Village NW to exceed the capped rates for Home and Community Based Services including but not limited to Brain Injury Waiver, Intellectual Disability Waiver and Habilitation Waiver. Motion carried by all ayes.

Moved by Friedrichsen, seconded by Farnsworth to adjourn to June 24, 2014. Motion carried by all ayes.
