Spencer Man To Federal Prison On Gun, Drug Charges

Spencer, Iowa — A Spencer man who reportedly unlawfully discharged a loaded firearm while under the influence of eight dfferent controlled substances was sentenced Wednesday to more than three years in federal prison.

According to the U.S. Attorney’s Office, 57-year old Shane Zellaha received the prison term after an August Guilty plea to one count of being an unlawful user of controlled substances in possession of a firearm.

Officials say the charge stems from an incident in January last year, when Zellaha reportedly discharged a loaded firearm while under the influence of methamphetamine, amphetamines, cocaine, ecstacy, marijuana, opiates, oxycodone, and benzodiazepines. 

According to authorities, Zellaha violated his state pretrial release by possessing additional firearms, ammunition, and a baggie that allegedly contained methamphetamine and drug paraphernalia.

After his federal indictment, authorities say Zellaha violated his pretrial release by failing to remove contraband from his residence, providing a diluted urine sample, skipping a urinalysis examination, skipping a substance abuse evaluation, and failing to abide by radio frequency monitoring.

Authorities say that, at the time of Zellaha’s arrest, U.S. Marshal Service deputies seized 24-hundred rounds of ammunition from his possession.

According to authorities, Zellaha was sentenced Wednesday in Federal District Court in Sioux City, and was sentenced to 37-months in prison. In addition, he must serve a three-year term of supervised release following his prison term.

There is no parole in the federal system.
