Man Arrested, Accused Of Theft From Bomgaars

Primghar, Iowa — A Moville man has been arrested on a felony warrant for theft and identity theft in connection with incidents last fall in Sheldon.

According to court records, 23-year-old Christopher Smith of Moville is accused by Sheldon Police of entering the Sheldon Bomgaars store on at least three separate occasions last fall, gathering merchandise, and attempting to charge the merchandise to a construction company. Court records accuse Smith of giving the name of an authorized signer for the construction company, signing that person’s name on the electronic signature pad, and leaving the store with the merchandise each time.

The court records give three totals under $1000, and one for $1727.92. Theft of that much merchandise at once is classified as Second Degree Theft in Iowa and is a class D felony. ID theft connected to such a value is also a class D felony in the state.

Smith is also charged with two other counts of ID theft, as well as third-degree theft, and fourth-degree theft, which are all misdemeanor offenses.

Court records indicate the warrant for Smith’s arrest was issued on December 22nd, 2017. He was arrested this past week by an O’Brien County Deputy. Court records indicate he faces arraignment on April 9th, 2018.

If convicted of a class D felony, Smith could face five years in prison and a fine of between $750 and $7500 according to Iowa code.
