Ocheyedan Man To Serve Jail Sentence, Probation After Pleading Guilty To Felony Drunk Driving

Sibley, Iowa — An Ocheyedan man will serve a jail sentence and probation among other penalties after he was convicted of felony operating while intoxicated.

The Osceola County Sheriff’s Office reports that 56-year-old Dean Robert Niswander of Ocheyedan pled guilty last week to Operating While Intoxicated, Third or Subsequent Offense, a Class “D” Felony.

Niswander was ordered to pay a total fine of over $4500, court costs and restitution of any court-appointed attorney. He was also sentenced to a five-year prison term, with all time suspended except for thirty (30) days. He will also serve two years probation and undergo substance abuse treatment. He must also obtain a sponsor.

On August 3, 2012, Niswander was stopped on Main Street in Ocheyedan for driving a golf cart without lights after dark. During the course of the stop, an Osceola County Deputy determined Niswander was drunk. Niswander failed sobriety tests and tested over .08.
