Sheldon Man Sentenced In Rural Road Assault Case

Orange City, Iowa — A Sheldon man has been sentenced to jail time, probation, and a suspended prison term after he participated in an assault this past winter, according to authorities.

Sioux County Attorney Thomas Kunstle says that 38-year-old James Earl Levi Wagner of Sheldon was sentenced for the crimes of assault with a dangerous weapon and harassment in the first degree, both aggravated misdemeanors.

Kunstle says that on January 23, 2018, law enforcement officers responded to a report of a man walking on Highway 60 in freezing temperatures. They found the man with bloody ice crystals frozen under his nose and shaking violently. Kunstle says that further investigation revealed the man was coerced under false pretenses into a vehicle and driven into the country by Wagner, who then physically assaulted the man and fired a 9mm handgun into the air to intimidate the man who immediately fled into the snow and cold.

Wagner was sentenced to a two-year suspended prison term on the assault with a dangerous weapon count and to 75 days in jail on the harassment count. Wagner must also serve two years of probation, successfully complete anger management classes, and will be prohibited from possessing firearms for life, according to Kunstle’s office.

The trial for Wagner’s alleged accomplice, Dustin Engelkes of Sheldon was to have started this Tuesday, September 18th, 2018. But at last report, it had been postponed. The pretrial conference is now scheduled for October 1st and the trial is now scheduled for November 6th, according to Kunstle’s office.
