State Sues Northwest Iowa Solid Waste Agency Landfill Near Sheldon

garbage can tub_sxcDes Moines — Iowa Attorney General Tom Miller announced this afternoon he has filed a lawsuit against the Northwest Iowa Area Solid Waste Agency near Sheldon.

Garbage haulers haul waste from residents of Sioux, O’Brien, Osceola, Clay and Lyon Counties to the landfill. The lawsuit alleges landfill managers did not install proper liners or a collection system to ensure hazardous liquids and other materials from about 300,000 tons of garbage didn’t leach into the soil. Prosecutors point to a 2007 state law that requires the liners and “leachate” collection system for landfills.

The lawsuit also alleges two cells for garbage went under construction before the landfill got the required state permits.

Landfill managers referred questions to Des Moines lawyer James Brick, who was not available late Thursday afternoon for comment.

    Sounds like landfill management knew what they were doing wasn’t kosher. This is a perfect example of why you do things correctly from the start. The corner cutting and rule breaking is going to cost more time and money in legal fees and fines than it saved.

    You may not agree with all the laws and regulations, but breaking them is only going to cause problems in the future.

    What happened to the previous director of the landfill that got them into this mess? Will he be a part of the lawsuit or is the new guy going to have to clean up the whole disaster?
