Estherville Man Faces Felony OWI, Child Endangerment Charges

Hospers, Iowa — An Estherville man has been arrested on felony OWI charges after a traffic stop near Hospers.

According to a criminal complaint filed with the Sioux County Clerk of Court’s Office by the county sheriff’s office, 31-year-old Adan Martin Lopez of Estherville is accused of driving drunk. He was arrested on Sunday.

In his statement, the deputy says another motorist reported that a vehicle was driving erratically on County Road B40. The driver that was alleged to have been driving erratically was said to have crossed the center line multiple times and almost drove off the roadway. When the deputy got behind the vehicle and activated emergency lights and siren, the driver took a mile and a half to stop. The deputy says the driver failed sobriety tests and admitted to drinking. He also blew over the legal limit, according to the deputy, who says a 2-year-old and a 6-year-old were in the vehicle at the time.

Because he had been convicted of OWI on two previous occasions, Martin Lopez was charged with 3rd offense OWI, a class D felony. If convicted, Martin Lopez could face up to five years in prison on the felony count. He also faces misdemeanor counts of child endangerment (x2) and failure to yield to emergency vehicle.

No court dates have yet ben set in the case.

At last report, Martin Lopez remained in the Sioux County Jail in Orange City without bond.
