Hartley Man Accused Of Distributing Marijuana And Magic Mushrooms Faces Four Felony Drug Charges

Hartley, Iowa — A Hartley man has been arrested on drug charges — four of them felony counts.

According to a criminal complaint filed with the O’Brien County Clerk of Court’s Office by the county sheriff’s office, 46-year-old Jeremy Rose of Hartley is accused of manufacturing psilocybin mushrooms (commonly called magic mushrooms). He was arrested on Thursday.

In his statement, the deputy says that the Iowa Division of Narcotics Enforcement conducted an investigation that led to the issuance of a search warrant at Rose’s home. The deputy alleges that during the search of the defendant’s home, psilocybin mushrooms (magic mushrooms) and items needed to manufacture them were located. Evidence of psilocybin mushroom distribution was also located, according to the deputy. He says they also found marijuana in amounts consistent with distribution and a digital scale.

Rose was charged with two controlled substance violations — one a class C felony and one a class D felony. He also faces a class D felony count of failure to affix a drug tax stamp and a class D felony count of gathering where controlled substances are used. If convicted of a class C felony, he could face up to ten years in prison, with five years in prison if convicted of a class D felony. He also faces misdemeanor charges of possession of a controlled substance (two counts) and unlawful possession of a prescription drug in connection with the case.

He faces a preliminary hearing on the charges on September 11th.

Rose was booked into the O’Brien County Jail in Primghar on Thursday and was released on Saturday after posting bond.
