Rock Valley Man Faces Felony, Other Charges After Car Strikes Tree

Rock Valley, Iowa — A Rock Valley man has been arrested on felony OWI charges near Rock Valley.

According to a criminal complaint filed with the Sioux County Clerk of Court’s Office by the Rock Valley Police, 31-year-old Milton Cuellar of Rock Valley is accused of driving drunk and striking a tree at a cemetery. He was arrested last week.

In his statement, the officer says Cuellar ran into a tree at 310th St. and Elmwood Avenue at the cemetery. He says a witness told officers that Cuellar never stopped at the stop sign. The officer says he noticed Cuellar was in the vehicle, attempting to drive it away. He says the odor of alcoholic beverage came from the vehicle, and Cuellar had an odor of alcoholic beverages coming from his person as well.

The breathalyzer registered 0.171% BAC, which is over twice the legal limit.

He says the vehicle also had an odor of marijuana. He says officers found two pipes and a grinder.

Cuellar was charged with operating under the influence, third or subsequent offense. If convicted, he could face up to five years in prison. He also faces misdemeanor charges of driving while denied or revoked, driving under suspension, possession of drug paraphernalia, driving without a license, failure to obey a stop sign, and failure to maintain control.

He faces a preliminary hearing on February 10th.

He was booked into the Sioux County Jail in Orange City and was released the same day after posting a $5000 cash or surety bond.
