Sioux City Man Faces Felony Charges In Sheldon After He Allegedly Tried To Avoid Arrest With A Firearm

Sheldon, Iowa — A Sioux City man has been arrested on felony firearm and interference charges after a traffic stop in Sheldon on Sunday.

According to a criminal complaint filed with the O’Brien County Clerk of Court’s Office by the Sheldon Police Department, 26-year-old Anthony Garcia of Sioux City is accused of attempting to avoid arrest while carrying a weapon.

In his statement, the officer says Garcia was being placed under arrest on charges of driving while barred and possession of marijuana. The officer says Garcia grabbed a bag and began to walk away, and had to be physically restrained and taken to the ground. He says there was a handgun in the bag. The gun had no serial number. Also found in the bag were an extended magazine and ammunition. The officer says that Garcia’s seven- and eight-year-old children were in the vehicle at the time.

Garcia was charged with dominion or control of a firearm or offensive weapon by a felon, dominion or control of a firearm or offensive weapon by someone convicted of domestic abuse, and interference with official acts with a firearm, all class D felonies. If convicted, Garcia could face up to five years in prison on each count. He also faces misdemeanor charges of carrying dangerous weapons while ineligible, two counts of child endangerment, driving while license denied or revoked, first-offense possession of marijuana, and driving while barred.

He faces a preliminary hearing on Monday, November 3rd.

Garcia was booked into the O’Brien County Jail in Primghar, and was released the next day after posting bond.
