South Sioux City Man Faces Felony OWI Charge After Stop Near Sioux Center

Sioux Center, Iowa — A South Sioux City man has been arrested on a felony OWI charge near Sioux Center.

According to a criminal complaint filed with the Sioux County Clerk of Court’s Office by the county sheriff’s office, 40-year-old Demarco Butts of South Sioux City is accused of driving drunk for the third or subsequent time. He was arrested on Sunday.

In his statement, the deputy says Butts was speeding and ran a stop sign about two and a half miles northeast of Sioux Center. The deputy says when he saw Butts, he had bloodshot, watery eyes and a strong odor of alcoholic beverage. The deputy also states that Butts had an open bottle of liquor. He says Butts refused both field and breath tests. The deputy states he also found marijuna and a knife with a 10-inch blade in Butts’ possession.

Butts was charged with operating while intoxicated, third or subsequent offense, a class D felony. If convicted, he could face up to five years in prison. He also faces misdemeanor charges, including driving while barred, possession or carrying of dangerous weapons while under the influence, possession of marijuana, driving while license denied or revoked, and possession of an open container of alcohol in a vehicle.

He faces a preliminary hearing on Tuesday, August 26th.

Butts was booked into the Sioux County Jail in Orange City, and was released the next day after posting a $5000 bond.
