A Legal Fight Over Odor In Spencer Appears Headed To Federal Court

Spencer, Iowa — Officials with the city of Spencer say they continue to receive odor complaints from the Symrise plant in that town.

The city recently filed legal action against Isonova, the company that owns the plant. It includes several municipal infractions and a request for an injunction and damages. City Attorney Don Hemphill told the council last week an attempt is being made to move the case to federal court.

Hemphill said another attorney from Spencer, who has experience in federal court cases, would then represent the city.

The company meanwhile is continuing work on a project to help mitigate the smell. They hope to have most of the work done in coming weeks.
