Lawsuit Filed Against Dickinson County Board Of Adjustment Re: Permit For Wind Project

Spirit Lake, Iowa — The subject of wind turbines has been a controversial one in Osceola and O’Brien counties. Now, a lawsuit has been filed in Dickinson County District Court contesting action taken by the Dickinson County Board of Adjustment in late April granting a conditional use permit allowing the Red Rock Wind Energy project to put up wind turbines in eastern Dickinson County.

The suit, filed by Dickinson County Concerned Citizens, or DC3, alleges the action was illegal, arbitrary, and capricious and that it will negatively impact aesthetics and property values. It also contends that there were several procedural errors during a public hearing that went over the course of three nights, and that the project fails to satisfy the requirements of Dickinson County’s zoning ordinances.

The plaintiffs are requesting the court to nullify the Board of Adjustment’s action and seek compensation for legal fees.
