Sheldon, Iowa — A nuisance abatement case filed by the City of Sheldon against the owner of a Sheldon residential property is going to trial.
According to Sheldon City Manager Sam Kooiker the property is located at 721 8th Street. Kooiker says the property is owned by Leviathan, LLC, and Damien Perkins of Leviathan made an initial court appearance Wednesday (October 30th) to plead Not Guilty to the municipal infraction.
Court documents indicate the municipal infraction charge comes because the property owner allowed overgrowth of vegetation, brush, and weeds on the property, as well as accumulating junk on the property including trash, paper, and debris. Documents also note the owner’s failure to adequately maintain and repair the garage door and screens ans windows on the house located on the property, and accuses the owner of failing to abate the nuisances in a timely manner.
Kooiker says the City of Sheldon appreciates the assistance of the property’s neighbors who recently mowed the law. He says the property has been vacant for several years, and the utilities have been turned off since sometime prior to 2010. He also notes that property taxes on the property that were due in March of this year have not been paid.
The municipal infraction trial is scheduled to begin at 10:45 am on Tuesday, December 3rd in O’Brien County Magistrate Court in Primghar.
