Sioux County, Iowa — A Hawarden man faces felony charges after a traffic stop on Sunday, November 9, 2025.
The Sioux County Sheriff’s Office reports that they arrested 47-year-old Jose Nunez of Hawarden during the stop, which occurred on Coolidge Avenue. They say a deputy checked Nunez’ vehicle speed at 89 miles per hour in a 55 miles per hour zone.
Upon further investigation, deputies suspected that Nunez was under the influence of alcohol and say they discovered an open container of alcohol and THC vaping devices. Nunez was also allegedly traveling with a person under the age of 18 in his vehicle, and allegedly had another person provide breath samples for his ignition interlock device so he could operate his vehicle.
Nunez was transported to the Sioux County Jail, where he was charged with Operating a motor vehicle while under the influence, third offense, a class D felony; child endangerment, a class D felony, and misdemeanor charges of possession of marijuana (3rd or subsequent offense), circumventing an ignition interlock device, operating a motor vehicle while drivers license barred, a speeding violation, and possessing an open container of alcohol while driving.
If convicted of a class D felony count, Nunez could face up to five years in prison.
He faces a preliminary hearing on Tuesday, November 18th.
Nunez was booked into the Sioux County Jail in Orange City and was released the same day after posting a $5000 bond.
