Larchwood Man Faces Felony OWI Charge

Larchwood, Iowa — A Larchwood man has been arrested on a felony OWI charge after a traffic stop near Larchwood.

According to a criminal complaint filed with the Lyon County Clerk of Court’s Office by the county sheriff’s office, 47-year-old Jeremy Underberg of Larchwood is accused of driving while under the influence for the third or subsequent time. He was arrested on Saturday.

In his statement, the deputy says Underberg had red, bloodshot, and watery eyes; mumbled speech; an odor of alcoholic beverage; and unsteady balance. He says he failed multiple field sobriety tests and allegedly admitted to having been drinking. The deputy says the preliminary breath test registered over the legal limit, and Underberg refused blood and urine tests.

Underberg was charged with operating under the influence, third or subsequent offense, a class D felony. If convicted, he could face up to five years in prison. He also faces a misdemeanor charge of driving while license denied or revoked.

He faces a preliminary hearing on Tuesday, June 24th.

Underberg was booked into the Lyon County Jail in Rock Rapids, and was released the same day after posting a $6000 bond.
