Suppression Motion Withdrawn; Other Subject Sentenced

Sibley, Iowa — One of the defendants in the case of four people charged with robbery in Osceola County was to have had a hearing on Friday.

Court records indicate the four are accused of the armed robbery of an occupied home on Third Avenue in Sibley.

On August 21st, 2016, Osceola County Deputies arrested four people after an alleged robbery. One of the four, 55-year-old Pedro Juan Figueroa Rios of Sioux City filed a motion through his attorney, Jared Weber, that says his fourth amendment constitutional rights were violated, and he wanted certain evidence suppressed, citing the custodial line up on a street, without control subjects, among other incidents.

But just hours before the hearing regarding the suppression of evidence was to have taken place, Figueroa Rios’s new attorney, Dennis Cmelik filed a motion to withdraw the motion to suppress the evidence. According to court records, no further information is available at this time.

Meanwhile, one of Figueroa Rios’s co-defendants has been sentenced for his role in the alleged robbery. Court records indicate that 26-year-old Peter Nazario Alvira had been charged with three counts of Burglary in the First Degree, Robbery in the First Degree, Going Armed With Intent, and Assault While Participating In A Felony. According to court records, on Friday, he was sentenced on only two of the burglary charges, and those were reduced to Third Degree Burglary. Nazario Alvira was sentenced to five years in prison on each of the two charges.
