Rock Rapids, Iowa — A Little Rock man has been arrested on a felony and several misdemeanor charges after a traffic stop on Sunday.
The Lyon County Sheriff’s Office reports that one of their deputies arrested 31-year-old Barry Arends of Little Rock on charges of OWI 3rd Offense, a Class D Felony; Driving While Barred, an aggravated misdemeanor; Possession of Controlled Substance-2nd Offense, a serious misdemeanor; and several simple misdemeanors, including two counts of Driving While License Suspended, Failure to Obey Stop Sign, Failure to Yield to Emergency Vehicle, and Littering.
According to the criminal complaint filed with the Lyon County Clerk of Court, Arends was stopped for a stop sign violation. The deputy says that before the stop, Arends was allegedly exhibiting suspicious/erratic driving behavior.
The report says the deputy attempted a traffic stop with his emergency lights, but Arends allegedly did not stop and started throwing drug items out the window. The deputy says the items were drug items and were recovered, including about an ounce of marijuana and a dime baggie with suspected LSD.
He says when Arends did come to a stop, the deputy detected strong odors of marijuana and alcohol. He says Arends displayed signs of being drunk but refused to submit to field sobriety tests, and a preliminary breath test and chemical testing via implied consent.
The report also says Arends is required to have an ignition interlock device installed on any vehicle he operates which he did not.
The Lyon County Sheriff’s Office reports that Arends was lodged in the Lyon County Jail where he was later released after posting an $8,000 surety bond.
