Sheldon Man Arrested On Felony Charge After Alleged Assault On Officer

Sheldon, Iowa — A Sheldon man has been arrested on assault on an officer charges in Sheldon.

According to a criminal complaint filed with the O’Brien County Clerk of Court’s Office by the Sheldon Police Department, 40-year-old German Ordenana Aguilar of Sheldon is accused of taking a swing at a police officer and later kicking him. He was arrested on Sunday.

In his statement, the officer says Ordenana Aguilar was called in as being an intoxicated individual in Kwik Star. Ordenana Aguilar left before the officer arrived, but the officer located him parked in the travelled portion of the road on Pine Street near 8th Avenue. He says Ordenana Aguilar also had a third brake light out on his vehicle. According to the officer, when he asked Ordenana Aguilar to get out of the vehicle he refused. After the officer opened the door for Ordenana Aguilar’s vehicle, he got out, says the officer, but he says Ordenana Aguilar took a defensive stance and balled his fists. The officer says he went to put Ordenana Aguilar into handcuffs, but Ordenana Aguilar turned towards the officer and swung his arm in an attempt to hit him. The officer says Ordenana Aguilar was than taken to the ground and handcuffed. Once at the jail, while bringing the defendant inside, the officer says Ordenana Aguilar kicked him in the upper thigh.

Ordenana Aguilar was charged with assault on an officer, a class D felony. If convicted, he could face up to five years in prison. He also faces misdemeanor charges of operating while intoxicated, assault, interference with official acts, disorderly conduct (loud noise), open container of alcohol by a driver, parking too far from the curb, and improper rear lamps.

He faces a preliminary hearing on Tuesday, May 28th.

At last report, he remained in the O’Brien County Jail in Primghar.
