Northwest Iowa Man Convicted In Second Felony Trial This Year

Spencer, Iowa — A northwest Iowa man was convicted in Clay County District Court earlier this week on Insurance Fraud charges, according to the Iowa Insurance Division.

Insurance Division officials say Scott Leininger was convicted Tuesday of 2nd Degree Theft, which is a Class C Felony, in Clay County District Court for the theft of insurance proceeds from his insurer. He was sentenced to a five year suspended prison sentence and ordered to serve five years of probation.

Officials say the charges stem from an incident in which Leininger filed multiple fraudulent insurance claims with his insurance carrier seeking reimbursement for damages which he alleged to have occurred to a motorized wheelchair, a biometric hand device and an elliptical rehabilitation machine.

This is Leininger’s second conviction this year on felony charges. On February 25th, he was convicted of Felony Forgery in Plymouth County for his role in altering business invoice receipts for the same repairs to a wheelchair, biometric hand device, and the elliptical rehabilitation machine. That conviction also led to a five year suspended prison sentence and court ordered probation for a term of five years.

State insurance officials say the two sentences will be served concurrently. They say Leininger’s restitution in the Clay County case is still pending.
