O’Brien, Plymouth County Attorneys To Assist Lyon County

Rock Rapids, Iowa — O’Brien County and Plymouth County will be sharing attorneys with Lyon County temporarily.

Current Lyon County Attorney Shayne Mayer has been appointed as a district judge in District 3A, which includes Lyon, Osceola, O’Brien, Cherokee, Dickinson, Clay, Buena Vista, Emmet, Palo Alto, and Kossuth counties.

But that means a vacancy in the Lyon County Attorney’s office, which reports that Mayer’s last day as Lyon County Attorney is this Wednesday, September 30th. Her first day as a judge will be Friday, October 2nd.

In the interim, while Lyon County looks for a new county attorney, there are 28E agreements now in force with both the O’Brien and the Plymouth County Attorneys’ Offices. The O’Brien County Attorney’s Office will handle interim coverage of the criminal and magistrate docket, and interim coverage of the juvenile court docket, mental health, and substance committals as well as assistance with the criminal docket as necessary will be handled by the Plymouth County Attorney’s office.

Mayer states that both attorneys will be available for emergency calls from the Sheriff Office. She says all Lyon County trials have been pushed to November to allow the new county attorney to handle the cases. Mayer noted that the county will not have an attorney for civil matters or closed sessions in the period of vacancy.

The O’Brien County Board of Supervisors approved the 28E Agreement for Lyon County to utilize the services of the O’Brien County Attorney or her assistant during the time that Lyon County is without a County Attorney on September 15th. The Lyon County Board of Supervisors approved the agreement on September 22nd.
