If convicted on a class C felony charge, Gamboa could face up to ten years in prison. The penalty if convicted of a class D felony is five years in prison.
He faces a preliminary hearing on March 10th.
At last report, Gamboa remained in the Sioux County Jail in Orange City in lieu of a $10,000 cash or surety bond.
