Sibley, Iowa — A Sibley man has been arrested on a felony assault charge in Sibley.
According to a criminal complaint filed with the Osceola County Clerk of Court’s Office by the county sheriff’s office, 29-year-old Alexis Hernandez of Sibley is accused of assaulting a victim who was allegedly trying to prevent him from driving home drunk.
In his statement, the deputy says the bartender at Rebar called the sheriff’s office to report that Hernandez had attempted to drive away from the bar and struck another vehicle while backing out of a parking spot, and attempted to drive away. The bartender and two patrons to whom she was giving a ride told the officer they attempted to intervene and told Hernandez to stop. At that point, Hernandez is accused of grabbing an electric cattle prod and swinging it at one of the patrons, striking him, and then shocking him with it. The officer says he was told the patron defended himself and struck Hernandez in the face, and Hernandez was apparently just coming to when the deputy arrived.
Hernandez was charged with assault while displaying a dangerous weapon, a class D felony. If convicted, he could face up to five years in prison. He also faces a misdemeanor charge of operating while intoxicated.
Hernandez has waived his initial hearing and has entered a plea of not guilty to the charges.
He was booked into the Osceola County Jail in Sibley, and was released on the next day after posting a $6000 cash or surety bond.
