Lyon County Deputy Arrests Sioux Falls Man For Felony Drunk Driving

Lyon County, Iowa — A Lyon County Sheriff’s Deputy arrested a Sioux Falls man for felony drunk driving during the wee hours of Sunday morning.

Court records indicate that the deputy was northbound on Highway 182 and came upon a Chevrolet pickup that was stopped on the side of the roadway. As the deputy prepared to stop, the driver drove off, going southbound on Highway 182. According to the deputy, the pickup drove over both the center line and the right-side fog line of the roadway within a mile. The deputy then initiated his emergency lights and pulled the vehicle over.

According to court records, the pickup was allegedly being driven by 31-year-old Ervins Manuel Diaz Herrera of Sioux Falls.

According to the deputy, the driver’s physical appearance, demeanor and behavior led him to believe that Diaz Herrera was intoxicated, so he was placed under arrest for Operating While Impaired (OWI), 3rd Offense, which is a Class D Felony.

A Preliminary Hearing in the case is scheduled for 9:00 am Wednesday April 20th in Lyon County Magistrate Court.
