Sioux Falls Man Faces Felony OWI, Other Charges In Lyon County

Inwood, Iowa — A Sioux Falls man has been arrested on felony OWI and other charges after the report of a suspicious vehicle near Inwood.

According to a criminal complaint filed with the Lyon County Clerk of Court’s Office by the county sheriff’s office, 30-year-old Juliano Rosete of Sioux Falls is accused of driving under the influence, hunting without a license, possession of a controlled substance, and carrying dangerous weapons while ineligible. He was arrested on Monday.

In his statement, the deputy says officers were dispatched to a suspicious vehicle about four and a half miles northwest of Inwood. The deputy claims there was the strong odor of marijuana emitting from the passenger compartment of the vehicle. He says marijuana was found inside the vehicle. According to the report, Rosete also had the strong odor of an alcoholic beverage emitting from his person and had an open container of alcohol in the vehicle. The deputy says Rosete also admitted to drinking and smoking marijuana within the hour. He is said to have failed field sobriety tests and submitted to a urine sample which preliminarily tested positive for THC.

The officer says Rosete and his passengers were road hunting and were in possession of three firearms and ammunition. No one in the vehicle possessed a hunting license.

Rosete was charged with third-offense operating while intoxicated, a class D felony. If convicted, Rosete could face up to five years in prison. He also faces misdemeanor offenses of carrying dangerous weapons while ineligible, possession of marijuana, open container of alcohol, fishing or hunting without a license, and no valid driver’s license.

He faces a preliminary hearing on February 1st.

Rosete was transported to the Lyon County Jail in Rock Rapids, but was released the next day to await his court date.
