Hull, Iowa — An Avon, SD man has been arrested on a felony OWI charge.
According to a criminal complaint filed with the Sioux County Clerk of Court’s Office by the county sheriff’s office, 51-year-old Benjamin Coburn is accused of driving under the influence for the third or subsequent time. He was arrested on Thursday.
In his statement, the deputy says he clocked Coburn at 74 miles per hour in a 55 zone and initiated a traffic stop near Hull. During the stop, the deputy detected the odor of an alcoholic beverage. Coburn consented to a preliminary breath test which showed his blood-alcohol level at 0.147. The limit is 0.08. The deputy says a check of records showed that Coburn had six prior arrests for OWI, with two convictions in the last twelve years.
Coburn was charged with OWI, third or subsequent offense, a class D felony. If convicted, Coburn could face up to five years in prison. He also faces a misdemeanor speeding charge.
A preliminary hearing was scheduled for March 11th, but that has been waived. No other court dates have yet been set.
At last report, Coburn remained in the Sioux County Jail in Orange City in lieu of a $5000 bond.
