(KIWA Staff Photo)Sheldon/Primghar, Iowa — A Sheldon woman already in custody on domestic abuse charges is now facing a felony charge after allegedly assaulting the county sheriff in jail.
According to a criminal complaint filed with the O’Brien County Clerk of Court’s Office, 25-year-old Fabiola DeLeon Matias of Sheldon was originally arrested on Monday. Jail staff indicate the incident occurred on Wednesday.
Courthouse records indicate DeLeon Matias is accused of throwing vases at a victim. She was charged with misdemeanor counts of domestic abuse assault, domestic abuse with a weapon, and interference with official acts. She was booked into jail, and on Wednesday, she was accused of being uncooperative with jail staff, so Sheriff Bruce Devereaux and jail staff entered a pod and advised DeLeon Matias to go to her cell. She is said to have refused and was then asked to place her hands behind her back, which she is also said to have refused. She collapsed to the ground on her own, says the report. It says she continued to refuse commands and caused injury to the sheriff by digging her nails into his arm and drawing blood. She also is alleged to have attempted to kick the sheriff and jail staff.
In addition to her other charges, DeLeon Matias now faces a charge of assault on persons in certain occupations (assaulting an officer), a class D felony. If convicted on that charge, she could face up to five years in prison.
A preliminary hearing in the case has been set for August 21st.
At last report, she remained in the O’Brien County Jail in Primghar in lieu of bond.
