Nebraska Man Facing Felony Firearms Charge And More After Accident

Alton, Iowa — A Nebraska man has been arrested on felony firearms purchase and misdemeanor theft and drug charges after an accident near Alton.

According to a criminal complaint filed with the Sioux County Clerk of Court’s Office by the Iowa State Patrol, 26-year-old Triston Frey of Grand Island, Nebraska is accused of the illegal possession of firearms and drugs.

In his statement, the trooper states that while investigating a traffic collision, Frey was found to be in possession of a stolen handgun and two loaded magazines. The trooper says Frey was a convicted felon in Nebraska and was prohibited from possessing a handgun in the first place, let alone one that was stolen. He says the gun had been reported stolen by the Aurora, Nebraska Police Department. The trooper says Frey also appeared to be under the influence of drugs. A drug recognition expert was called in and it was his professional opinion that Frey was under the influence of a stimulant. The trooper says Frey was also found in possession of methamphetamine.

Frey was charged with a class D felony charge of fraudulent purchase of firearms and/or ammunition and misdemeanor charges of fourth-degree theft, operating under the influence, and possession of a controlled substance. If convicted, Frey could face up to five years in prison on the felony count alone. He also faces a motor carrier safety rules violation and a charge of failure to maintain control.

No court dates have been set yet in the case.

Frey was released the day after the arrest after posting a $5000 bond.
