Alvord Man Faces Felony Drug Possession Charge After Tow Operator Finds Drug Paraphernalia

Inwood, Iowa — An Alvord man has been arrested on felony drug possession charges after a traffic stop near Inwood.

According to a criminal complaint filed with the Lyon County Clerk of Court’s Office by the county sheriff’s office, 59-year-old Troy Fodness of Alvord is accused of the possession of methamphetamine and drug paraphernalia. He was arrested on Saturday.

In his statement, the deputy says Fodness was stopped and arrested for traffic violations and his vehicle was towed. As the vehicle was being towed, the deputy says the tow operator discovered what he believed to be drug paraphernalia on the floor of the pickup that had rolled from under the seat. The tow driver informed the deputy and the deputy executed a search warrant on the vehicle. He says he found a glass pipe (as described by the tow driver) on the driver’s floor with both a crystalline substance and burnt residue. The deputy says the crystalline substance was consistent in appearance with methamphetamine and field tested positive as such.

Fodness was charged with possession of a controlled substance. Since he has been convicted twice before for drug possession, the charge was upgraded to a class D felony. If convicted, Fodness could face up to five years in prison.

Fodness also faces misdemeanor charges of driving while license denied, suspended, cancelled, or revoked; possession of drug paraphernalia; failure to provide proof of financial liability (no insurance); and operating a non-registered vehicle.

Fodness faces a preliminary hearing on the charges on February 14th.

At last report, Fodness remained in the Lyon County Jail in Rock Rapids in lieu of a $5000 bond.
